    Here again, I am dismayed.  Shocked!  So, a parent can instruct a child to try to kill the other parent, and because a Florida statute is written too narrowly, it is not considered abusive!  Plain and simple, as is all too often the case, lawyers can petition cases and wrap them up in so much legal conflict that ineffective, unjust decisions can be made.  Who suffers?  Certainly, not the judges who have not witnessed the long-term affects that verbally abusive language has on a child and that child's ability to function well in society.  I wonder, will these judeges remember the children that they have allowed to be verbally abused without punishment to the abuser?  It is time to stand up for children's rights!  It is time to shake up the state of Florida and hold lawmakers accountable for their decisions!  I cannot state enough that it appears that the real focus seems to be lost, and that is the welfare of the children.

    The Florida legislators DO need to pick this up and TAKE ACTION and look out for the welfare of the 3.9 MILLION children in FLORIDA.   CHILD ABUSE is serious.............There is nearly 3 million reports of CHILD ABUSE made annually......in 2003, there were 906,000 child abuse convictions...........Edward Muano was one of those convictions..............but that changed with his appeal in 2006 from the 4DCA.....which overturned his child abuse conviction due to the vagueness of the FL Child Abuse statute......yet the 1DCA upheld another conviction for Eric Coleman concerning the same Child Abuse statute..........which brought conflict.

    When the STATE OF FLORIDA filed with the FL SUPREME COURT ......looking to the higher court to take jurisdiction over the MUNAO Case...........to clear up the conflict among these two FLORIDA DISTRICT courts the FL SUPREME COURT   refused the case.............and CLOSED the Munao Case.

    We may be left to assume a variety of reasons why the Justices of Florida Supreme Court mandated their order referring to the Florida Constitution , Article V, Section 3(b) which is referring the JUSTICES  may use their own Discretion..........We will never know their reasoning behind their FIRM order issued for this case....................although many were shocked by their final order and could not believe that the higher court did not take a stand in this CHILD ABUSE ISSUE ....... however this does not change the problem within the statute! 

    It will be in the hands of the FLORIDA LEGISLATORS NOW!!!!!

    Watching the O'Reilly Factor was the first publicity I have seen of the kind of child manipulation and abuse that I have been dealing with. It is refreshing to see that I am not alone in what seems to be a disastrous and oppressive reality for innocent children. Good for you for staying strong!

    The father of my children is an attorney practicing in the same courts as my domestic case. He has manipulated to unbelievable extremes. At one point, my seventeen year old healthy and strong son had been in a headlock by his father for hours. When he came to me his neck was 3 times the size it should have been with hard-swollen lymph vessels, and he could only moan from the pain. I took him to the court hearing 2 weeks later to get a change of custody and have him tell the judge what happened. The judge refused twice my attorney's plea to hear my son's story, and then the judge looked at my son and threatened to throw him in juvenile jail if he did not immediately go back to live with his father and quit complaining.

    That is one of many twisted events in a custody case that is over 8 years in court and going nowhere, by the court's own discretion.  All but one of my 7 children are emancipated and now realize the sad truth of what their father is and does. Unfortunately, the 13-year-old girl is still under his roof  (by his manupulation of the court), and is not allowed to THINK anything he does not approve. He keeps her in a church-school where he is a staff member, and where the Superintendant has viable accusations against him for sexual impropriety with boy students. BTW, the court refuses a change of venue.

    hello...abusebyjustice,

    I am so sorry to hear about your son ...family courts defiantely have a large travesty when they are dealing with custody battles and denying the truth to be heard in open court ................the courts not only put the children in danger but prolong this type of abuse to take place.  It is an emotional strain on all family members, especially the impressionable children who are torn between their parents and the legal system that should protect them.

    Tell me about it! I have been in all corners of the family court ring. Sorry to say, politics and cronyism have more to do with what happens there than concerns for any children or families. Included in this are the "symbolic gestures" that the court takes to show it's power and influence.

    There needs to be some major changes to the system but as long as the public buries it's collective head in the sand, the status quo will continue on.

    TEXAS...........10 YEAR OLD BOY SHOOTS & KILLS FATHER

     Aug, 2004 Texas circuit court judges put a gag order on this case but prior to the order media reported...............Ten year old boy shot and killed his father with a .40 caliber handgun....when the father  came to pick him up for a visit.   

    The mother Deborah Lohstroh was filling her son with poison known as PAS ...  She made allegations that the father Dr. Rick Lohstroh sexually abused her sons; allegations were all unfounded and the father took two lie detector tests.....according to Texas newspapers.  

    The ten year old boy was on PROZAC for two weeks prior to the shooting........even though his dad an ER DOCTOR did not want him to take this SSRI.   The news reported a history of domestic violence between the two parents followed by a messy divorce.  The mother was issued a protective order........however, she had prior arrests for DV and lost custody of her two children to the grandparents after the death of her X- husband. 

    The grandparents and parents of Dr. Lohstroh  filed a wrongful death lawsuit against the mother and her new husband for failing to keep the pistol out of reach of the childrenAlso lawsuit has been filed against the makers of PROZAC.

    Another question was a 1.4 Million dollar insurance policy. The brother who was eight told insurance attorney when asked to describe scared or something uncomfortable.....the boy answered..........."When I was 8 my dad died....I was scared!  My mom told my brother to shoot my dad but my grandparents came to help me. "

    This is a a tragic story ...........but no there is no mention of  charges brought up on the MOTHER.....Deborah Lohstroh ..........other than the wrongful lawsuit by the grandparents...............why is that??? 

    This Ten year old boy was brainwashed............but for who's gain and why ........there were no winners in this circle of domestic violence ..........

    The Factor explored one of the more bizarre crimes in recent years.  41 year-old Edward Munao called the home where his former girlfriend was living with their 6 year old son, then told the boy to pick up a knife and stab his mother.  Jodi Walsh, Munao's intended victim, said her son is still exeriencing ill effects from the episode.  "He is suffering from post-traumatic stress disorder.  He worries about his father getting out of prison and coming after him or possible me, and he lives in constant fear.  He is in therapy and we're going to get over this as a family."  The Factor reported that part of Munao's conviction was overturned on the grounds that words alone do not constitute child abuse.  "I'm worried about this guy coming after you.  It must be just a horrific prospect to face.  You just can never relax."

    PLAY TOLD OF PEDOPHILIC STEPFATHER, MURDER OF 13 YR-OLD BOY 

    The college student responsible for yesterday's Virginia Tech slaughter was referred ;last year to counseling after professors became concerned about the violent nature of his writings, as evidenced in a one-act play obtained by The Smoking Gun.  The play by Cho Seung-***, a 23-year old English major, was submitted last year as part of a short story writing class.  Entitled "Richard McBeef", Cho's bizarre play features a 13 year-old boy who accuses his stepfather of pedophilia and murdering his father.  A copy of the killer's play can be found below.

    CHILDREN FAMILIES & ELDERLY AFFAIRS COMMITTEE HEARING

    CRIMINAL CONDUCT...................SB 2736

    "Mental Abuse" would be clearly defined in child abuse law so that prosecutors can charge people with child abuse even if they don't physically harm the child, under a bill approved by a SENATE panel.

    While child abuse already includes "mental abuse" under the state law, a recent district court decision threw out a conviction under that law because it said the law didn't define what "menatl abuse" meant. 

    Bill (SB 2736) sponsored by SEN. ARONBERG (D) was approved in Senate Children  Families & Elder Affairs.

    SENATOR Evelyn J. Lynn voted  against this BILL ......and against vicitm compensation for children ...... lynn.evelyn.web@flsenate.gov

    "MOMMY STABBED ME"  ...........Boyton Beach , FL .....  April 19, 2007

    Woman admitted to stabbing her three yr-old son with a 12-inch kitchen knife.  Franca Gasperetti, 43, of Floral Park, NY was arrested Thursday on attempted murder and aggrevated CHILD ABUSE.  The mother initially claimed robbers attatcked her and her son.  She also told police she "snapped" when she heard that her lover's wife called her husband and told him of their affair while they were vacationing  in FLORIDA.  According to her affidavit she was having and affair with her husband's friend and this had been exposed.  Gasperetti is being held without BAIL at the Palm Beach County Jail.

    The three old boy is listed in serious condition but stable.

    ALEC BALDWIN'S THREATENING MESSAGE TO DAUGHTER

    BALDWIN'S tape rcorded message to his daughter, Ireland released to the public is quite disturbing.  It is definately degrading and insulting!!  The news media is saying "BAD PARENTING"................

    TMZ.com  describes these comments to be volcanic tirade of threats and insults to Baldwin's 11 yr-old daughter.......where he calls her a "THOUGHTLESS LITTLE PIG" and bashing her mother Kim Basinger.

    Family law judge was very alarmed at the comments made on the daughter's cell phone and BANNED CONTACT from Baldwin to see his daughter until their court hearing scheduled for May 4, 2007.
