    SUPREME COURT TO HEAR DOMESTIC HOMICIDE CASE

    SIXTH AMENDMENT........... "CONFRONTATION CLAUSE"

    Giles vs. California  will be argued possibly in April, 08.  This appeal was brought by Dwayne Giles, California man accused of shooting and killing his former girlfriend, Brenda Avie.

    Several weeks before the murder, Brenda Avie told police that Giles was threatening to kill her.

    The BIG issue is whether the police officer's testimony is admissible.

    This issue was brought before the Supreme Court in 2004.  Crawford vs. Washington 2004,  emphasized right of defendants to confront a state's witnesses.  In that case, Supreme Court Justices ruled unanimously that statements from witnesses who do not come to court and thus cannot be confronted by their accusers SHOULD BE EXCLUDED!!!

    "It is therefore likely that the justices accepted the new case to make it clear that as long as the victim's unavailability as a witness was a foreseeable consequence of murder, the Sixth Amendment does not require stte to prove actual motive for the murder was to make the victim unavailable,"  The New York Times, reports.

    Port St Lucie, FL 

    POLICE:  WIFE TRIED TO RUN OVER HUSBAND 20 TIMES

    as reported by the AP on March 23, 2008 (MSNB.COM)

    A Port St. Lucie woman, Leslie Ann Brown faces charges of aggrevated assault w/ deadly weapon and child abuse.   Wife was released on $2,750 bond.

     Mother exercised at least some precaution with baby as deputy dryly noted in the report:  "The child was buckled up inside the van the entire time while defendant was pursing the vicitm".

    Just read the facts about FLORIDA.....

    child abuse issues should be a state legislators concern.....

    For the children of Florida .....I hope that these budget cuts are not implemented because the children will suffer in the long run and they are the future of tomorrow.

    Abuse is serious and must be addressed by the legislators ........

    Children need to be proteced from emotional abuse and all types of abuse.

    They are innocent and do not need to be victims.

    It is sad that the legislators in Florida did not support this bill for mental injury for the children.  However .....persistance will pay off.  It always does.

    SHAME ON THESE POLTICIANS that speak when it is election time about children's rights and then after they are elected in they quickly forget what they said or just seem to forget about the children and their rights.

    It is election time again and boy we see all the time these politicians spend on the PRIME issues ............but people see through them....look at the presidential election and health care.......see what happens after one of them gets in office.  

    keep working on this it will pass ................keep updating us on this issue

    We have read information on this website about the legislative efforts of Walsh......We are wondering which politicians are supportive of the legislation.  Has anyone contacted Govenor Crist?  The Gov has advocated for PAS awareness and seems to be involved concerning these issues that effect parents.  PAS is used in any courtrooms and divorces from our knowledge the Govenor is trying to create awareness for this.  One can assume he supports that PAS.............and may even promote this disturbing claim when one uses it against another and they use the children as tools.  Can anyone give us more information......

    Childs Cry for Help is working on legislation efforts for the criminal conduct  bill.
    Rep. Gayle Harrell is running for US CONGRESS and will not be able to sponsor the bill.  Senator Dave Aronberg has sponsored the bill for the past two years and will co-sponsor the bill for this upcoming session 2009.  Senator Ronda Storms co-sponsored the bill this past session.

    We are working on sponsors for the House of Representatives and Senate for the Criminal Conduct Bill.....and will keep you updated.

    "THE NEW ENGLAND PATRIOTS TAKE THE CONDUCT OF OUR PLAYERS VERY SERIOUSLY."  The team issued a statement concerning the recent release of thier defensive back, Willie Andrews.

    Willie Andrews was arrested for an illegal possession of a firearm and assault with a dangerous weapon.  Andrew's live in girlfriend told police that he held a gun to her head.  This is Andrew's second arrest this year.  The Boston Globe reported "The Patriots were not as understanding with Andrews this time, probably in part because the case involved alleged domestic violence."  Owners Bob & Myra Kraft are advocates for domestic violence prevention.

    The Democratic Party stated  "Ending Violence against women must be a priority"  and that's just what the Democratic nominee for Vice President, Senator Bidon has accomplished for ALL women in the United States.

    Senator Biden is an author of the Bi-Partison VIOLENCE AGAINST WOMEN ACT & a co-sponsor of the Bi-Partison INTERNATIONAL VIOLENCE AGAINST WOMEN ACT.

    • One in every three women has been beaten, coerced or abused during her lifetime.            

     WHAT IS DOMESTIC VIOLENCE?

    Domestic Violence is a crime.  It is defined as a pattern of coercive tactics, which can include psychological and emotional, social, financial, physical and sexual abuse, perpetrated bya family member or household member, spouse, boyfriend, significant other, with the goal of establishing or maintaining power and control over the victim.  Domestic Violence can happen to anyone.

    FORMS OF DOMESTIC VIOLENCE

    Domestic Violence can take many forms and can happen occasionally or all the time.  Examples are listed:

    OCTOBER is  DOMESTIC VIOLENCE AWARENESS MONTH

    In the United States, 1 out of every 4 women will experience some type of abuse within their intimate relationship.

    Every nine seconds a woman is battered at the hands of an abusive partner.

    Dynamics of Domestic Violence

    Domestic Violence is all about the abusive partner having control which effects the entire family.  The behavior exhibited by the abuser is an escalting pattern of behavior that is designed to intimidate and control.  NOTE:  Emotional Abuse always starts with Domestic Violence and the layering effect may adversely influence the survivors coping skills and responses.

    I would pay to have a chip inserted behind both my daughters ears for tracking purposes. I wish is existed today.

    I could care less if Big Brother was watching if it meant I could find my kids in the case of the worst thing happening to them.

    I would do anything to keep them safe.

    According to the FAMILY VIOLENCE PREVENTION FUND, growing body of research reveals that domestic violence and child abuse occur in the same families and are highly associated with similiar social and economic risk factors.  Data also show that the children growing up in violent families are more likely to engage in youth violence.  Given these findings, an effective strategy to combat child abuse, domestic violence and youth violence would be collaborative, community based prevention/early intervention effort that aims to reduce the social and economic risk factors for at risk families.
